BANKRUPTCY PROCESS - FILING INFORMATION
In order for you to have a smooth filing here are a few tips:
1. Complete the Credit Counseling to receive your certificate before filing. (for approved agencies please visit http://www.justice.gov/ust/eo/bapcpa/ccde/cc_approved.htm We recommend (http://www.abacuscc.org/)
2. Include last 60 days of paystubs with the documents provided.
3. Include Credit Counseling Certificate with your filing.
4. File all documents both the original and a copy with the Clerkâs Office along with your filing fee or fee waiver, the copy will be stamped and given back you for your records.
(If you are mailing the documents, be sure to include both the original and a copy and send along a self-addressed stamped envelope, so that the copy can be mailed back to you for your records.)
5. After filing, complete the Personal Financial Course. (this course can be completed with the same company you completed the Credit Counseling with)
6. After receiving the Certificate complete the B23 form (included in your documents) and file with the Clerk. (both Certificate and B23 form must be filed within 45 days of your 341 Meeting of the Creditors Hearing)
7. After you file, you will receive a notice of your meeting of the creditors along with the name and address of your Trustee, you must mail your most recent tax return to the Trustee.
To be safe, also bring a copy of your most recent tax return with you to your meeting of the creditors along with your ID and social security card.
